What are the requirements for an uncontested divorce?

An uncontested divorce is simply one in which both parties agree on all of the terms, usually because they've been married for a long time and have no property or children. The requirements for an uncontested divorce are:

-You must have been married for at least two years

-You must have lived in the same state as your spouse during the marriage

-You must not currently be separated (living apart)

-You and your spouse must agree on all of the terms of the divorce, including custody, child support, and spousal support

If you meet all these requirements, your divorce will be uncontested.

To get divorced, you usually need to be legally separated for at least six months before you can file. You also must be able to prove that your marriage is irretrievably broken. This means that there's no way you'll reconcile and that your marriage has caused you physical or mental harm, or that it's simply not working out. If you and your spouse have lived apart for two years, you can file for divorce even if you haven't proven that the marriage is irretrievably broken. The first step in any divorce is to determine whether it will be contested or uncontested. A contested divorce is one where both sides are unable to agree on how to handle the details of their divorce, and must work with a judge to come up with a fair resolution. Uncontested divorces occur when both sides are able to come to an agreement on all the details of their divorce without going through a judge.
